PORT CLINTON -- A former Elmore police officer will not serve jail time after he admitted to exchanging inappropriate text messages with a 14-year-old girl and trying to cover it up.

Harder pleaded guilty Tuesday to attempted contributing to the unruliness of a minor and complicity to obstruct justice -- both misdemeanors. Ottawa County Common Pleas Judge Bruce Winters issued a suspended sentence of 120 days in jail. In exchange, Harder must remain law-abiding for a year and stay away from the victim and her family for three years.

"My behavior has caused pain and ridicule to my family, friends and to the law enforcement community," Harder said in a sworn statement to the court. "My activities tend to disrespect those who engage in the honorable profession of law enforcement. For all this, I am deeply sorry.

"All this is entirely my fault."

Winters also ordered Harder to pay $600 in fines and set a hearing for 8:30 a.m. Aug. 26 to determine how much Harder owes the victim and her family in restitution for counseling expenses.

Harder had been scheduled to stand trial on five felony charges -- two counts of illegal use of a minor in nudity-oriented material or performance, two counts of disseminating matter harmful to a juvenile and one count of tampering with evidence -- and four misdemeanor charges -- three counts of contributing to the unruliness or delinquency of a child and one count of obstructing official business. If convicted on those counts, he could have been sentenced to a maximum of 21 years in prison, said his attorney, Tom DeBacco of Port Clinton.

"They made him an offer he couldn't refuse," DeBacco said of the prosecutor's office. "He couldn't play Russian roulette with his future."

Harder was fired from his part-time position with the Elmore Police Department in March 2010 after he had been suspended while the Ottawa County Sheriff's Office investigated him regarding the girl and after an unrelated misdemeanor charge was filed against him.

During the hearing, Ottawa County Prosecutor Mark Mulligan discussed in detail Harder's interaction with the girl and the effect it had on her and her family.

Harder met the girl at the Ottawa County Fair in July 2009. She had turned 14 a month earlier and had just finished eighth grade, her father said.
