: A House Judiciary subcommittee today puts the spotlight on bribery and international accounting issues when it examines the Foreign Corrupt Practices Act. The Crime, Terrorism and Homeland Security panel will hear testimony from George Terwilliger, the head of White & Case's white collar practice, and Shana-Tara Regon, director of white collar crime policy at the National Association of Criminal Defense Lawyers, as well as former Attorney General Michael Mukasey. Justice Department Criminal Division chief Greg Andres will also testify. Global white collar crime and compliance with FCPA standards have been increasingly lucrative areas of legal practice. Simpson Thacher & Bartlett made headlines this month when it hired Cheryl Scarboro, head of FCPA enforcement at the Securities and Exchange Commission. And earlier this year White & Case expanded its transnational white collar crime practice when it recruited Charlie Monteith, a senior official at the U.K. Serious Fraud Office for its London office. : The U.S. Department of Housing and Urban Development has accused the Bank of America of impeding an inquiry into the lender's home-foreclosure practices. The government said BofA "significantly hindered" the probe by providing incomplete information and being slow to hand over data, Bloomberg reported, citing evidence in a lawsuit against BofA by the state of Arizona. The state accuses the bank of misleading troubled homeowners who wanted to have their mortgages modified. : The New York and Delaware attorneys general are cooperating in an investigation of how big banks documented the packaging of mortgage loans into securities, the New York Times reported. Eric Schneiderman of New York and Joseph Biden III of Delaware are seeking information from Bank of New York Mellon and Deutsche Bank, the two largest loan-bundling trustees. Such trustees neither originated nor serviced loans but administrated the creation of the securities. Judge Says Bank Not Liable/Responsible for Losses from Fraudulent ACH Transactions (June 6, 7, 8 & 9, 2011) A judge in Maine says that Ocean Bank is not responsible for fraudulent financial transactions that cost a local business more than US 0,000. Magistrate Judge John Rich said that Patco Construction Company should have taken better care to protect account access credentials. In the last several years, US small and medium-sized businesses have lost hundreds of millions of dollars to fraudulent automated clearinghouse (ACH) transfers. Although the judge agreed that the bank's security measures "were not optimal," he said that the law does not require banks to implement the best measures available, and that measures in place at Ocean Bank were comparable to those in place at other banks. The ruling is a recommendation and must be formally adopted by the overseeing judge.
