Student eyeing emigration options

Good day Mrs Ffolkes-Abrahams:

I am an undergrad student at the University of Technology studying for a Bachelor of Science in hospitality and tourism management. I am also doing a minor in meeting and special events.

If I am to live and work in Canada for a year, can I apply for permanent residency after the year is up, if I desire to stay?

Do I have to leave the country once my permit is up, if I am eligible to apply for this status or can I stay once I have applied?

If I am eligible to apply for permanent status, how long does the process take?

Can I apply within the year I am there working?

I am presently engaged to be married next year, does this affect my chances of getting the work permit? If I decide to stay and my husband would like to migrate to Canada, what would I have to do for this to be done?

You have asked many interesting questions. The first is with respect to living and working in Canada for one year.

For this to become a reality, you will need a job offer first and then you will have to apply for a work permit. Your employer may be required to obtain approval from Human Resources and Social Development Canada for the job in the form of a positive Labour Market Opinion. You will need the job offer and the approval for your application for your work permit and also proof that you are qualified to do the job. Once approved, you would be considered a Temporary Foreign Worker in Canada.

Secondly, you ask about permanent residency in Canada. Under the Canadian Experience Class of Immigration, after two years of successfully working in Canada in a full-time job with the proper work authorisation, you may apply for permanent residence status. Your work would have to be within the Skilled Work categories of either Managerial, Professional or the Skilled Trades. You may apply while you are still working in Canada or within one year after you leave your employment. The new regulations allow you to work for a limited period of up to four years. If you apply for permanent residency within the required period, you will have to ensure that you keep your work authorisation current. You must apply for extensions of your work permit to keep your status in Canada while awaiting your application for permanent residency. Once you have the proper authorisation, you may continue to stay in Canada. However, if the period of your work permit is not extended, then you are required to leave Canada.
