Texas officer killed when fleeing vehicle hits him

BEAUMONT, Texas — A Texas man has been charged with capital murder after intentionally driving his fleeing sport utility vehicle into the patrol car of an officer, who was struck and killed, police said.

Bond was set at $250,000 Saturday for John Wesley Nero, 30, of Beaumont in Southeast Texas, KFDM-TV reported. He remained in a hospital in serious condition for injuries he sustained in the Friday night crash.

Beaumont Police Chief Frank Coffin said Officer Bryan Mitchell Hebert, 36, had stopped his patrol car about 10:45 p.m. Friday and was retrieving road spikes from his trunk to try to stop the fleeing SUV when the vehicle struck the patrol car head-on, pushing it into the officer.

Hebert, who served 10 years with the department, was pronounced dead at a Beaumont hospital.

Police said officers were pursuing Nero because he had been involved in a domestic disturbance Friday evening and assaulted his mother and grandmother. According to an affidavit, Nero allegedly told his mother that he would kill everyone if police were called.

Coffin said the two women told officers they caught Nero looking at what they believed to be child pornography and that he became enraged and struck them both when they confronted him about it. The women said he left the home after hitting them.

Officers later spotted Nero behind a department store and tried to speak with him, but they say he sped away. A high-speed chase was under way when Hebert parked his vehicle and attempted to retrieve the spikes to put down in the roadway. The SUV struck the patrol car, which according to the affidavit had its emergency lights on, head-on.

Authorities believe a number of people may have seen what happened, and they are asking witnesses to contact police.

Hebert was a correctional officer before joining the Beaumont department. He was sworn in as an officer in January 2001.

He is the 17th Beaumont police officer to die in the line of duty since 1881.The last Beaumont officer killed in the line of duty was Lisa Beaulieu, who was struck by a drunk driver on April 27, 2007, while she was providing traffic assistance at an accident scene.

Police Chief Mark Blanton of neighboring Port Arthur said he's sending officers to Beaumont to help patrol and provide whatever assistance is necessary while Beaumont police mourn the death of their colleague.

BEAUMONT, Texas - From U.S. Attorney's Office - A 49-year-old Baytown, Texas man has pleaded guilty in the Eastern District of Texas to disposing of hazardous wastes without a permit, announced U.S. Attorney John M. Bales today.

Clinton Promise pleaded guilty to disposing of hazardous wastes without a permit in violation of the Resource Conservation and Recovery Act (RCRA) on July 1, 2011 before U.S. District Judge Marcia Crone.

The RCRA criminalizes the storage, transportation, or disposal of hazardous wastes without a permit.

According to information presented in court, in March 2006, Promise took payment from HOT Transport, a chemical transportation company in Lufkin, Texas, in exchange for illegally disposing of approximately 45,000 lbs. of tank wash wastewater that constituted hazardous wastes. The wastes possessed the hazardous characteristic of Ignitability and Benzene Toxicity.

Promise disposed of the hazardous wastes at a tank wash facility in Houston named QualaWash. QualaWash was not permitted to receive, treat, or dispose of hazardous wastes. QualaWash management had no knowledge of the disposal. Promise is a former employee of QualaWash and he was familiar with the facility’s equipment and he was still in contact with some of his former co-workers there. One QualaWash employee was fired for allowing Promise to dispose of the wastes at the site.

At the time, HOT Transport offered commercial transportation of industrial liquids such as caustics, ethanol, methanol, hot wax, cresol, and formaldehyde. HOT was located on FM 2021 in Lufkin, Texas, but is no longer in business.

The former president of HOT Transport, David Overdorf of Lufkin, has also pleaded guilty disposing of the company’s hazardous wastes without a permit. Overdorf admitted that he had directed HOT employees to wash out the interiors of trailer mounted tanks at HOT's place of business knowing that the trailer mounted tanks contained hazardous wastes.

Overdorf admitted that he had directed his employees to pump the tank wash wastewater, containing hazardous wastes, from a catch basin into a trailer mounted tank labeled wastewater at HOT's place of business and then to accumulate and store the wastes in an onsite tank trailer mounted tank labeled wastewater at HOT's place of business.

Overdorf then directed an HOT driver to transport approximately 45,000 lbs. of the hazardous wastes in a trailer mounted tank from HOT's place of business to Quala Wash in Houston, Texas for disposal and authorized payment of $450.00 to Clinton Promise for the disposal.
